Membership

Through Our Content, you might have the opportunity to make purchases to become a "Member" with special access to the content ("Order"). We retain the right to reject any Order you place with us. At our discretion, we may limit or cancel quantities of Orders per person or household. Payments

To register for our Retreats, a $500 deposit is required in order to reserve your place. The balance, including taxes and any other charges) is due two weeks prior to the start of the Retreat. To make a payment via Our Website, you may need to provide specific details, including your credit or payment card number, expiration date, billing address, shipping information, or similar payment data. By providing such information, you assert that you possess the authority to use the credit or payment card or other payment method you submit for the payment, and you confirm that you have the necessary authorization to carry out the transaction.

Upon submitting this information, you grant MBS Retreats the permission to share it with third parties to facilitate your payment. However, it's important to acknowledge that MBS Retreats is not accountable for the actions of third-party credit card or payment method processors, including how they handle, store, use, or disclose your information.

 

Cancelation

If you wish to cancel a subscription, you can provide notice of subscription cancellation at any time. Your cancellation will take effect at the start of the next monthly billing period. However, you'll retain access to the applicable content for the current month you've already paid for.

For Retreat Cancelations, you need to notify us in writing, via email to admin@mybestselfretreats.com

For cancelations received 11 days or more prior to the starting date of the Retreat, we will issue a credit for the amount paid, that will be valid for future use within the next 180 days from the date of the cancellation notice. 

For cancelations received within 10 days  prior to the starting date of the Retreat, there will be no refund or credit, due to limitations in the contract between MBSR & the Hotel in which the Retreat takes place.

 

Security

While we implement reasonable security measures to safeguard your information, we can't provide absolute assurance of its complete security. There are circumstances where third parties might gain unauthorized access to our server and view your information, either by intercepting it during transmission over the Internet, through email, or by other means. When you provide information to MBS Retreats, you acknowledge being aware of these risks.

If you're uncomfortable submitting your information electronically, you have the choice to refrain from doing so. However, in such cases, you might not be able to access the full functionality of Our Content. It's important to understand that MBS Retreats isn't responsible or liable for the consequences of illegal actions by third parties, including hacking or similar activities.

YOUR SOLE REMEDY FOR DISSATISFACTION OR PROBLEMS WITH OUR CONTENT OR ANY OF ITS CONTENT IS TO STOP USING OUR CONTENT.

THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE(S).

SOME STATES DO NOW ALLOW THE LIMITATION OF LIABILITY SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. IF ANY PART OF THIS LIMITATION OF LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF MBS RETREATS AND ITS AFFILIATES UNDER SUCH CIRCUMSTANCES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED WILL NOT EXCEED THE GREATER OF: (I) $100, OR (II) AMOUNT OF FEES PAID BY YOU TO MBS RETREATS IN THE PRECEDING TWELVE (12) MONTHS.

 

Arbitration

Any controversy or claim (“Claim”) you have arising out of or relating to these TERMS & CONDITIONS shall be resolved by a single impartial arbitrator pursuant to proceedings administered by the American Arbitration Association under its rules for resolution of commercial disputes. Any such Claim shall be brought solely by you as an individual and not as part of, or as a representative of, a class. The arbitration shall be held in Fort Lauderdale, Florida. All submissions to the arbitrator, the proceedings and the award shall be confidential. The arbitration shall be conducted on an expedited basis with minimal discovery. The arbitrator’s award shall be final and binding.

 

Governing Law and Statute of Limitations

Any claims relating to, and the use of, Our Content are governed by the laws of the State of Florida, without giving effect to any choice or conflict of law provision or rule.

For enforcement of any arbitration award, or in the event arbitration is not permitted or required, then for any claim or action that may be submitted to any court, by using Our Content, you consent to personal jurisdiction in the federal and state courts of Florida, which will have exclusive jurisdiction for any action arising out of or relating to Our Content or your use of Our Content. Such claim or actions shall be instituted exclusively in the federal or state courts located in the City of Austin, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Before seeking any legal remedy for any harm you believe you have suffered arising from or related to your use of Our Content, you agree to inform us in writing and give us 30 days to cure the harm before initiating any action. You must indicate any cause of action within one (1) year after the claim has arisen, or you will be barred from pursuing any cause of action.

 

 

No Class Actions

You agree to bring any claim or cause of action arising under or related to these TERMS & CONDITIONS, Our Content, or any dispute with MBS Retreats in your individual capacity, and not as a member or representative of any class or collective action.

 

General

You may not assign any rights or obligations under these TERMS & CONDITIONS without MBS Retreats’s prior written consent. MBS Retreats may assign part or all of these TERMS & CONDITIONS. All sections of these TERMS & CONDITIONS which by their nature are designed to survive expiration or termination of these TERMS & CONDITIONS will survive. No waiver of any of these TERMS & CONDITIONS will be deemed a further or continuing waiver of such term or condition or any other term or condition. These TERMS & CONDITIONS, together with the Privacy Policy, constitute the entire agreement between you and MBS Retreats, superseding any other agreement between you and MBS Retreats with respect to such subject matter. If any provisions of these TERMS & CONDITIONS are found to be unenforceable, such provision shall be deemed modified to the minimal extent necessary to render it enforceable and if that is not possible such provision shall be deemed severed, and the other provisions will still remain in full force and effect.
